Terms of Service
Last updated
These terms cover Larchmont CRM, the software at crm.larchmontdigital.com and on the custom domains our clients connect to it. The CRM is made and run by Larchmont Digital, a marketing agency in Los Angeles, California. Signing in means you accept these terms on behalf of the business whose workspace you use.
Who can use it
Accounts are created by invitation. A business gets a workspace under a services agreement withLarchmont Digital; the owner of that workspace invites their team. Each person signs in with their own account and is responsible for what is done under it. Keep your password to yourself, and turn on two-step sign-in when the workspace asks for it. Tell us right away at hello@larchmontdigital.comif you think an account has been misused.
Your data is yours
The contacts, conversations, deals, recordings, forms and documents in a workspace belong to the business that owns the workspace. We process them only to run the service for that business and as described in our privacy notice. You can export contacts and deals as CSV from the CRM at any time. When an agreement ends, the workspace stays available for export for 30 days, and is then deleted along with its backups on their normal schedule.
What you agree to when you message people
The CRM sends text messages, e-mails and calls in your business's name. You are the sender, and the law that applies to the sender applies to you: the TCPA and the CTIA guidelines for texting, CAN-SPAM for e-mail, and the recording-consent laws of the states you call. In practice:
- Promotional texts go only to people who gave your business written permission. The CRM records that permission and refuses a promotional text without it; do not work around that.
- Every marketing text names your business and tells the reader how to stop. Every marketing e-mail carries an unsubscribe link. The CRM adds these; do not remove them.
- The information you give for A2P 10DLC registration (your business, your use case, your sample messages) must be true. Carriers suspend campaigns registered with false information.
- Call recording is off unless you turn it on, and when it is on the CRM plays a notice to both sides. Some states require every party's consent; it is your responsibility to know which.
- No content the carriers prohibit: sex, hate, alcohol, firearms, tobacco, cannabis, gambling, loans and debt collection, or anything illegal.
The AI features
The assistant can answer customers by text and the copilot can carry out tasks in the CRM for you. Both work from what you write about your business and from the data in your workspace, and both can be wrong. You decide when they run and you are responsible for what goes out in your name. Anything the assistant is unsure about is handed to a person; anything the copilot would send, delete or close is confirmed by you first. Conversations handled by the AI are processed by the AI provider named in the privacy notice.
Other services the CRM depends on
Texts and calls go through Twilio, e-mail through Resend, payments through Stripe, and the integrations you connect (Google, Meta, Microsoft) through those companies. Connecting an account means you have the right to connect it. Usage fees for these services are set out in your agreement with Larchmont Digital; your plan includes an allowance, and the Usage page in Settings shows what your workspace has consumed.
Availability
We work to keep the CRM up around the clock and keep daily backups, but we do not promise uninterrupted service. We may take it down briefly for maintenance and will keep those windows short. A public status address, /api/health, reports whether the service is running.
Acceptable use
Do not use the CRM to break the law, to send unsolicited messages, to probe or overload the service, to reach data that is not your workspace's, or to build a competing product from it. We may suspend an account that does, after telling the workspace owner unless the law prevents us.
Fees and ending the service
Access to the CRM is part of your services agreement with Larchmont Digital, and that agreement sets the fees, the term and the notice period. When it ends, so does access, subject to the 30-day export window above. We may end access sooner for a breach of these terms.
No guaranteed results
The CRM is a tool. More leads, more replies and more sales depend on your offer, your market and what you do with the tool, and we do not guarantee them.
Liability
To the extent the law allows, our total liability for any claim connected to the CRM is limited to the fees you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss. Nothing here limits liability that cannot be limited by law.
Changes
If we change these terms in a way that matters, we will tell workspace owners by e-mail before the change takes effect. The date at the top says when they were last revised.
Governing law
These terms are governed by the laws of the State of California, and the courts of Los Angeles County have jurisdiction over any dispute.
